2. Scope of Works
2.1 Total Plant Care (“TPC”) will maintain the common property and grounds to a neat, tidy, and functional standard.
2.2 Full scope of works is outlined in the “Scope of Works” document.
2.3 Tasks may be performed on a rotational or as-required basis.
2.4 Exclusions:
Emergency call-outs are not included in the scope of works unless separately approved.
Any work outside the agreed scope may incur additional charges or may be declined at TPC’s discretion.
3. Managed Maintenance and One-Off Services
3.1 Services are delivered according to the agreed maintenance schedule.
3.2 Optional newsletter-style updates on completed works are available as part of a managed maintenance agreement.
3.3 One-off or irregular services are quoted separately. Sample pricing includes:

4. Pricing and Payment
4.1 Fees are payable fortnightly or monthly unless otherwise specified.
4.2 Payment is due on the date indicated in the invoice.
4.3 TPC reserves the right to suspend services if payment is overdue.
5. Client Responsibilities
5.1 The client must provide:
Safe and clear access to all areas for scheduled works
A nominated point of contact for approvals and communication
Notification of hazards or risks on site
5.2 TPC is not responsible for delays or missed works caused by inaccessible areas, locked gates, or unsafe conditions.
6. Liability
6.1 TPC carries public liability insurance and operates in accordance with workplace health and safety regulations.
6.2 TPC is not liable for:
Damage to underground services not marked or known to the client
Pre-existing property damage
Loss of income or consequential losses resulting from delays
6.3 Any additional work performed outside the agreed scope is at the client’s risk until formally approved.
7. Damages
7.1 TPC is not responsible for damage to common property or personal property.
7.2 TPC may, at its discretion, repair or make good any damages caused during works.
The client agrees that Total Plant Care is the sole party responsible for the performance of the services under this agreement. No claim may be made against the personal assets of the directors, owners, or operators of Total Plant Care. Liability is limited to the company’s assets and insurance coverage.
8. Termination
8.1 Either party may terminate this contract at any time for a legitimate reason with two weeks written notice (unless otherwise agreed).
8.2 Fees for services already rendered remain payable.
9. Changes to Terms
TPC may update these Terms & Conditions periodically. Clients will be notified of significant changes, and continued engagement constitutes acceptance.
10. Governing Law
This contract is governed by the laws of Queensland, Australia.
Acknowledgment
Acceptance of invoices or Quotes and/or payment for services provided by Total Plant Care constitutes acknowledgment and agreement to these Terms & Conditions.
